This website is operated by Marley's Homeware. Throughout the site, the terms "we", "us" and "our" refer to Marley's Homeware. Marley's Homeware offers this website, including all information, tools and Services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and Services to you.
Nothing in these Terms of Service affects your statutory rights as a consumer.

By agreeing to these Terms of Service, you confirm that you are at least 18 years old, or that you are the age of majority where you live and have given us your consent to allow any of your minor dependents to use this site.

Certain products or Services may be available exclusively online through the website. These products or Services may have limited quantities and are subject to return or exchange only in accordance with our Returns Policy.
We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any colour will be accurate.
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or Services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time. Any offer for any product or Service made on this site is void where prohibited.
Section 6 — Your Consumer Rights
If you are a consumer, you have legal rights that these Terms do not affect.
Under the Consumer Rights Act 2015, the products we supply to you must be of satisfactory quality, fit for purpose, and as described. If a product is faulty, not as described, or unfit for purpose, you may be entitled to a repair, replacement, or refund. Our first step for genuinely faulty goods is usually to provide replacement parts where this fully resolves the issue, with a return or refund available where it does not.
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, if you are a consumer buying online you generally have the right to cancel your order within 14 days of receiving the goods, without giving a reason, subject to the limited exceptions set out in those Regulations. Where this statutory right applies, it sits alongside (and is separate from) any goodwill returns window or guarantee we choose to offer.
Full details of how to return an item, our voluntary returns window, guarantees, and warranties are set out in our Returns Policy. Where our Returns Policy is more generous than your statutory rights, the more generous terms apply; nothing in our Returns Policy reduces your statutory rights.
Section 7 — Accuracy of Billing and Account Information
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and payment card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.

You must not reproduce, republish, copy, distribute, sell, or otherwise exploit any content from the site for commercial purposes without our express written permission. Nothing in these Terms transfers any intellectual property rights to you.

Section 13 — International Orders, Customs and Import Duties
We ship within the UK and to selected international destinations, including the EU and the US.
Orders delivered to the EU: customs duties and import taxes are included in the price you pay at checkout. You will not be charged any additional duties or taxes on delivery.
Orders delivered to all other countries outside the UK and EU: your order may be subject to import duties, taxes, and customs clearance fees levied once the parcel reaches its destination. These charges are determined by the destination country and are your responsibility. We have no control over these charges and cannot predict their amount. You are the importer of record and are responsible for complying with all laws and regulations of the destination country. Please contact your local customs office before ordering if you are unsure about the charges that may apply.
International returns: for orders delivered outside the UK, you are responsible for the cost of returning the item to us. If a parcel is returned to us because import duties or taxes were not paid, or because delivery could not be completed for reasons within your control, a £10 handling fee may be deducted from any refund due, in line with our Returns Policy.
Section 14 — Errors, Inaccuracies and Omissions
Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order), except as required by law.
We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website should be taken to indicate that all information in the Service or on any related website has been modified or updated.

To the fullest extent permitted by law, Marley's Homeware, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, Service providers and licensors will not be liable for any indirect, incidental, special, or consequential loss, including without limitation lost profits, lost revenue, lost savings, loss of data, or replacement costs, arising from your use of the Service or any products procured using the Service.
Nothing in these Terms of Service excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any breach of the rights and guarantees implied by the Consumer Rights Act 2015 or any other liability that cannot lawfully be excluded or limited; or (d) defective products under the Consumer Protection Act 1987.
If you are a consumer, this section does not affect your statutory rights.
Section 17 — Indemnification
You agree to indemnify, defend and hold harmless Marley's Homeware and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, Service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable legal fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party. This Section does not apply where you are acting as a consumer.
Section 18 — Complaints and Dispute Resolution
We want every customer to be happy. If you have a complaint, please contact us first at info@marleyshomeware.co.uk and we will do our best to resolve it quickly and fairly.
If we cannot resolve a dispute between us, you may be able to refer it to an alternative dispute resolution (ADR) provider. The EU's Online Dispute Resolution platform was permanently closed on 20 July 2025 and is no longer available; consumers in the EU should instead use the relevant national ADR body in their country. This does not affect your right to bring proceedings in court.
Section 19 — Force Majeure
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations that is caused by events outside our reasonable control, including without limitation strikes, failure of suppliers or carriers, acts of God, fire, flood, severe weather, epidemic or pandemic, war, civil unrest, interruption or failure of utilities or telecommunications, or import/export restrictions. If such an event occurs, we will contact you as soon as reasonably possible and our obligations will be suspended for the duration of the event.
Section 20 — Severability
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service. Such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

The courts of England and Wales shall have jurisdiction to settle any such dispute or claim. If you are a consumer resident elsewhere in the UK or in the EU, you may also benefit from any mandatory protections and may be entitled to bring proceedings in the courts of your country of residence.
